There are some jurors who believe that at the end of the trial involving medical malpractice, an accident case or even a wrongful death case, the judge will tell the jury how much he believes the injured victim or their surviving family is entitled to.

Nothing could be further from the truth.

In New York, in civil lawsuits where an injured victim or the surviving family is trying to obtain compensation for all the harms and losses they suffered because of someone else’s negligence, the judge is NEVER, EVER to voice his own opinion about who is more likely right than wrong.

The judge is never to voice his opinion about how much money he believes the injured victim should receive.

In a jury trial where members of the community are called upon to come to a consensus about who they believe and who they don’t believe, it is the jury’s function to make a decision about how much money an injured victim should receive.

In a non-jury trial, the judge is known as the factfinder as well as the person who makes rulings of law. In that situation, the judge would then decide whether the injured victim was entitled to be compensated, and if so, how much.

In a jury trial, the judge CANNOT and WILL NOT give the jury any guidelines about how much compensation they should be giving to the injured victim. Instead, both the plaintiff’s attorney and the defense attorney will likely give the jury some idea about what each believes the injured victim is entitled to.

As large as these trucks are, even a relatively low impact collision can often lead to serious injury or even death. A typical fully loaded commercial truck can weigh over 80K lbs., while an average passenger automobile weighs only approximately 3K lbs.
When my lay firm is hired to represent the family of a person seriously injured or killed in a truck accident collision we immediately start investigating different factors that could determine and affect the value of these cases.

Some of these factors are:

Was the truck driver fatigued at the time if the accident?
Was the driver properly licensed?
Was the truck company negligent in hiring and retaining the driver?

We immediately want to get a copy of the truck drivers log. Truck drivers are required to log their hours, which reflects when the driver starts their day and all the stops along the way and it certifies that he/she has inspected the tractor and the trailer that they are operating. These logs can also be used as evidence that the driver was speeding between their last stop and where the wreck occurred, or that they were suffering from driver fatigue because of the numbers of hours spent on the road.
We will also take a look at the drivers unemployment file and driving record, we’ll make sure they were properly able to drive the truck. And if the driver wasn’t the trucking company can be held liable for the accident under neglect hiring and retention.

What Is My Personal Injury Claim Worth?

When we’re valuing personal injury claims, we’re looking at a couple of different components and then we’re adding them all up to figure out what a dollar amount value will be for your claim.

So, here’s what we’re looking at. The first question we have to answer is, what is the money available? If you’ve been in an auto wreck and somebody else caused an accident but that person doesn’t have any insurance for whatever reason, or they don’t have a penny to their name then the value of the case is gonna be very limited because there isn’t any money to go get. On the flip side, if you’ve been in an auto wreck and the person who hit you has a million dollar insurance coverage then you know that is not gonna be an issue. Then there’s gonna be enough money available to compensate you for the full value of your claim.

The second question we ask is, what are the total medical bills in your case? So, the personal injury claim by its very nature has injuries. And injuries are treated in hospitals or urgent cares or by chiropractors or by orthopedists, and they’re all done in a medical setting and they all have medical bills associated with it. And so, these are economic damages and we want to know what the total economic damages are in your case, the total medical bills. And we also want to know what your total out of pocket is. In other words, what has insurance covered or what has your PIP insurance covered if it’s an auto accident claim?

We next want to find out what your lost wages are. This is another sort of economic damage, right? It’s something that we can put an actual, to the penny we can figure out what your lost wages are. And so if you had to leave work under doctors orders and you weren’t able to work for a couple of weeks and you make 20 bucks an hour, then we can figure out the exact dollar amount of your lost wage claim.

Now the next question, and this is the big one in an injury case is, what is your pain and suffering? And this is an intangible amount. It’s not like medical bills where we can say, “Your pain and suffering was worth to a penny, this particular number.” It depends, k? And what it depends on is, how has this accident affected your life? And there are two different places that we’re looking at.

One is, what are the things that you used to be able to do and you can’t do now? What has been taken from you? Maybe you used to go to the gym every day or maybe you used to run every day and now you can’t do that. And so that is a part of pain and suffering, that we’ll sit down and figure out a value to do the best we can to compensate you for what’s been taken from you.

The second part is, what are the things that you still do ’cause you have to do them, but they’re really hard to do right now? So for example, if you gotta work and you still have to go and drag yourself into the office every day or whatever it might be, but it hurts now. You have to do it, but it stinks for you now. It’s painful. The only way you can get through it is to take a bunch of pain med in the morning and then when you go home you pay for it. We call these, the technical term is duties under duress. But we want to know what those are because that’s a big portion of your pain and suffering claim.

The last question we want to know is, what is the liability in your case? So is it 100% clear that this injury that you have, that the accident was caused by somebody else? So for example, you have your motor vehicle car wreck where somebody runs a red light and plows into you while you’re just parked. In that case, we know that liability is 100% clear, right? It’s not your fault at all. Or, is it the situation where it’s vague or maybe there was a sideswipe and it’s a little bit harder for us to prove the liability at 100%? We want to know that because it factors into your claim.

People who have been badly hurt or lost a loved one typically have larger concerns then money. But at some point, you want justice. The civil justice system only provides monetary compensation to bring about justice. So money is what every personal injury is — and should be — about.

So it is fair question to ask what every client wants to know: how much is my case going to be worth? This video explains the “formula” insurance companies, defense lawyers, judges and juries use when trying to figure out how much money should be awarded (or offered in a out-of-court settlement).

So the purpose of this video is to give victims and other lawyers real information as to just how personal injury claims are valued for settlement.

A question came in from Jonathan in Florida. And Jonathan’s question was, “I got into a car accident and there was some other people in the accident. Somebody actually died in this accident.” It was … sounds like it was a traumatic accident, and I hope you’re okay Jonathan. And his question is, “Is my case worth $100,000?” That was his question. And so of course, the obvious answer is I don’t know, Jonathan. I don’t know anything else about your case. I don’t even know what insurance coverage is. I just know that you got into a bad accident it sounds like. But I do want to answer that question to kind of give you a framework so that you understand how cases are valued.

And what it comes down to is liability and damages. Or, who’s at fault? Was there an accident and was it somebody else’s fault? So, Jonathan, if you were in this accident and somebody else caused the accident, then yes, there’s going to be value to your claim, because we know that it’s about who’s at fault. And if somebody else had caused an accident, then that’s the first. And then the second part is what are the damages? If you have damages as a result of an accident where somebody else is at fault, then you’re going to have value to your claim. And when we talk about damages, there are a couple different types real quick. There are economic damages. Jonathan, if you are out-of-pocket because you had to go to the doctor. You have a bunch of doctor bills or if you lost wages, you can’t go to work. Those are economic damages. We can put a value on those. And you would include that. That’d be part of the value of your claim.

There are also future economic damages. Jonathan, if your accident was really bad and you are going to have future medical treatment or you’re going to have future lost wages, there’d be a value to that and that would factor into your claim. If you suffered a permanent injury, this is under Florida law, but if you suffered a permanent injury then you can also ask for pain and suffering or damages that are intangible. They can be a little bit harder to quantify, but as a very, general, basic rule of thumb you can anticipate that somewhere between one and three times your economic damages that can be something that you can ask for potentially for pain and suffering.

Those are kind of the frameworks and the factors and the things that we look at. You probably want to go ahead and talk to an attorney about it a little bit more in detail to bring your specific facts to the attorney so that the attorney can give you a little bit more specific answer as to what you’re looking at.
