It’s Not Often a Client Cries at Deposition, but When They Do a Remarkable Thing Happens…

An injured victim who brings a lawsuit seeking compensation for the harms and losses they suffered is asked questions during their pre-trial testimony, known as a deposition.

With severely injured victims, the pain they have endured is horrific. The suffering is unbearable.

Their disabilities are obvious.
Their inability to do life’s daily tasks are impossible or nearly so.

Attorneys often ask these crippled victims to recount in detail what their day is like. In some instances, the injured client breaks down in tears. Real tears. Painful tears.

When that happens, something remarkable occurs.

The attorney is doing his job to learn how this victims’ injuries have affected her on a daily basis. They need to learn what activities they can no longer participate in. The lawyer is trying to determine what they used to be able to do in the past and understanding how their injuries are preventing them from their current activities.

But when a client breaks down, while being questioned, the defense lawyer gets a sense of something more than just a simple checklist or recitation of ones’ injuries.
