How to Maximize the Value of my Personal Injury Case

You’ve been injured as a result of an auto wreck or some other personal injury claim and you want to know how to maximize the value of your case. My name’s Chris Denmon, I’m an attorney at Denmon and Pearlman, and I want to talk about exactly what we do to maximize the value of your case if you’ve been injured.

The reality of it all is that you have to have your case built, because of the other side, the insurance adjusters and then ultimately the insurance attorneys, they want to pay you as little as possible. Of course, they do, they’re insurance companies. They are big business, they make billions of dollars, so the way the make billions of dollars is to fight your claims to give you the least amount of money possible.

So what do we do? We build your case. How do we build your case? The lawyers, we’re doing our thing to make sure that we can prove fault or liability. So, if there’s an auto wreck, we’re interviewing witnesses and we’re going and we’re talking to the police and we’re taking pictures on scene and all that stuff. That’s what we do.

But what can you do? Well, if you’ve been hurt, you have an obligation, a duty ,to try to get better, okay? That means that you have to go see the right medical providers or treatment providers for you so that they can diagnose you with a record form the very beginning and they can put you on a treatment plan to get better. For some people that are injured in a personal injury claim they are able to get better. They do within six, seven, eight weeks. Maybe the see a chiropractor or some other conservative treatment, and that doctor or chiropractor does their thing and they’re able to get the person better. Which is great, that’s perfect, and those cases have a certain value. It’s not the highest value, because our clients have gotten better, so what’s happened to them isn’t the wort thing in the world.

But for other clients and other people that have been injured, especially in auto wrecks or serious slip and falls, they may have permanent injuries. In other words, they might go to at doctor for six or seven, eight weeks, and the doctor will do, or the chiropractor will do what they can to get them better, and they may feel somewhat better, but ultimately they may have a herniation or a back injury or a tear or something that’s a permanent injury. The sort of thing that not just six months from now, but a year from now, or two years from now, they’re still going to be hurt. In those cases, you need to continue treating. You need to continue fining doctors that are going to help you get better, and if they can’t help you get better, to at least manage the pain.

What we’ll see is we’ll see people start with the conservative care with a chiropractor, and the chiropractor will do the best they can, and ultimately the chiropractor may move them up the ladder so our clients are seeing orthopedic specialists or other doctors that may have more invasive treatment to help my our clients better. Sometimes that works, and sometimes it doesn’t work. Sometimes it helps but it doesn’t actually make our clients better. Then we want our clients to if they need to see a pain management doctor, see a pain management doctor. If they have to go see their primary care at some sort of regular basis, see their primary care.

In other words, always do what you can to try to get better, let us know who you’re seeing, and by doing that it’s a win-win because you’re getting better, or you’re at least managing your pain, or at least keeping your injury from getting worse, and you’re also creating a written record that’s memorialized that we can pull the records of. And at the end of the day, when it’s time to settle your case, we can show the insurance attorney or the insurance adjuster exactly what your story is, exactly how this accident or car wreck or slip and fall as affected your life over an extended period of time. That’s building your case from the very beginning and continuing to do what you need to do to get better, also builds your case and maximizes the value for us when we’re trying to either settle your claim or get into litigation.

How Does a Lawyer Maximize Personal Injury Recovery?

Today lets talk about hiring a lawyer: Specifically how does a lawyer maximize my injury recovery?
Insurance adjusters will say, “Why hire a lawyer? You will just have to pay the lawyer out of the settlement.” They leave out the part about how the insurance will pay more if you have a lawyer.
Think I am exaggerating?
Then why doesn’t the insurance adjuster suggest you hire a lawyer? The lawyer does most of the work on the claim? Would be easier for the insurance adjuster.
The answer is simple, the insurance company has to pay more when you have a lawyer because you are aware of your options: take it to court, etc.

Hopefully, You don’t get in a car wreck every day. But a lawyer the focuses on personal injury does negotiate on these type of cases every day.

Insurance companies will not contact you to tell you that their insurance policy may have to pay on your claim. You have to figure it out on your own. Lawyer adds value here by knowing where to look for additional insurance.
Lawyer adds value by taking you out of the process personally.
Was your friend or family member driving.
You want to make a claim but are afraid it will anger them?
Hire a lawyer and you can just say, “My lawyer is dealing with the insurance company.” And leave it at that.
Lawyer adds value by negotiating with medical providers, health insurance companies and government entities like Medicare and Medicaid to reduce the amount they get paid back out your settlement.
This means more money for you in your pocket.
Lawyer adds value by delaying debt collectors and collection lawsuits until the settlement is completed.
This avoids ruining your credit
It is also important to get a lawyer involved early. To put it bluntly before you screw up your case. Once the insurance company’s computer software puts a value on your claim, there is no way to change it. Even if the insurance adjuster agrees with you, they cannot change the initial value. It is best to hire a lawyer to make the best case for a higher value when the claim is first submitted to the insurance company.
This is why it is a bad idea to wait until the insurance company makes an offer before deciding whether you should hire a lawyer or not.
Can I just use my family lawyer that did my will or handled my paternity case?
When you go to your family lawyer and ask him if he has handled a case like your personal injury case before, he will say, “Yes, I have handled a number of cases like that.” What he does not say is the number is zero.
It does not cost more to get a lawyer with experience in personal injury cases. You should get a lawyer that knows what he is doing.
If I hire a lawyer, do I have to file a lawsuit?
No, less than 5% of my cases end up as lawsuits.
Lawyer negotiates a settlement in 95% of the time.
But insurance company knows that lawsuit is an option when you have a lawyer, so they pay more money in settlement.
Best of all, with a contingency fee you do not have to pay your lawyer up front.
If you do not recover, you do not have to pay your lawyer at all.
And your lawyer’s goals are aligned with yours, the more money your lawyer recovers for you, the more he makes for himself. Therefore, he will be working hard to get you more money.

I had an auto accident in which I was not at fault. My SUV was hit on the rear while I was making a left turn. I had to file a claim to the other Party’s Auto insurance company. In this video I share my experience, story, and 3 tips as to how you can maximize/increase your auto insurance claim. A lot of people settle for the first offer not knowing that it is negotiable. A lot of people believe they are being treated fairly by Insurance Companies, and sometimes people are treated fairly and sometimes they are not. It is your job to do your homework. Know what your car is worth(plus property taxes, sales tax, and extra costs of searching and buying a new car).
3 Tips:
1. Know that your Insurance claim is always negotiable. You do not have to settle for your first offer and take it. The insurance companies can always increase their offer to you. If you refuse to settle for the first offer they usually will increase their first offer.

2. Always say “NO” to their 1st and even 2nd offer and back up your stance with good logical reasons. Provide good reasoning.

3. Address the other details besides the accident and damages such as missing work, physical pain, medical issues, trauma, pain and suffering, extra expenses and costs due to accident etc…. Turn little details into a big issue and dramatize.

At the end if you feel you are being treated fairly and getting a fair compensation for your damages it would be up to you to decide to settle or not to settle. Even when you get your insurance claim check for your car repairs, the repairs may take 1-2 weeks in which case you will not have access to your car. So you will have extra expense of renting one. You have to add that rental into your claim during your negotiations….
