How many times have you seen on TV an attorney tell you in a 30 second commercial that he can get you a “Quick settlement?”
How many times have you seen a lawyer’s marketing message proclaiming that you need a quick settlement and should call him right away?
I see these legal marketing messages often.
Before you jump the gun and decide you want a quick settlement for your car accident, you need to stop and ask this important question…
“Do you really want a quick settlement for your car accident case?”
Why do I suggest this?
There’s an important reason…
Shortly after your car accident, there’s a very good chance that you will not know what the true extent of your injuries and disabilities are for the future.
You likely will not know what your prognosis is either.
If your injuries are significant and you required surgery, hospitalization or rehabilitation, if you settle your case quickly there is a very good chance that you are losing significant opportunities that you would have if you simply waited.
Keep in mind, you cannot wait too long because there are strict time limits in which you have to file a lawsuit seeking compensation for the harms and losses you suffered as a result of someone else’s carelessness here in New York.
However, when you see ads by attorneys on TV,
When you hear them on the radio,
When you see them on billboards and
When you read in the newspapers and magazines proclaiming that they can get you a “quick settlement,” you need to stop and ask yourself the real question about whether you truly want and need a quick settlement.
It might be necessary for you to file a lawsuit in order to maximize the amount of compensation you are to receive. You might not truly understand the full nature of your injuries or disabilities months or even years after your accident.
The insurance companies would love to get your case resolved within a few days, weeks or months. This minimizes the amount of compensation they will have to pay out for you. You on the other hand might be losing significant compensation if you opt for a “quick settlement.”
The reality is that different injuries affect people differently.
If you suffer a femur fracture and require surgery known as an open reduction internal fixation surgery and you are 25 years old, you might be up on your feet quicker than if this happened to a 70-year-old who was hit by a car while crossing the street.
The elderly person might require many more months of physical rehabilitation. They now may be at greater risk for falling. They might be more susceptible to suffering another fracture.
The only true way to understand the full extent of your injuries and disabilities are to continue treating with your medical doctors and for your attorney to speak with your treating doctors to get a full sense of what the future holds for you and what type of treatment, if any, you will require into the future.
That will have a significant impact on whether or not to begin negotiating with the other driver’s insurance company. Also, a little-known secret involves how much insurance coverage the careless driver had at the time of your accident.
The purpose of this video is to simply make you aware that when you see these marketing messages proclaiming that you can get a ‘quick settlement’ for your injuries, the answer is you can. The better question you should be asking is “Should you?”
